Wow what a great discussion! I have "first hand" witnessed some of these as i posted before. i have seen them destroy mailboxes, not rip them to shreads but dent them from the inside out. there is some SMALL force with these things. i believe that at worse some cuts or eye irritation are at worse case scenario. Just to note if you see one walk over slowly reach down take the cap off away from your face should not have any harm. Secondly i would check with all law enforcement in your area before making them for pleasure but i do not believe they are classified as a "bomb". ( i am not saying anyone is wrong or right just stating my opinion and experience ) ( ive seen kids do worse with gasoline )

Some kid did something similar to this a few years ago and put it in some kid's backpack on school campus. Then I remember everyone hearing a bang but no one knew what it was until later in the day a letter was sent out to our parents. It explained what happened and how the kid got expulsion and so on. Luckily the kid was not hurt.
