At this time the complaint itself isn't available on PACER, but a hearing notice has been issued in the case. While the specifics aren't available, the documents indicate that Long and BLAST are suing over a contract dispute. The lawsuit indicates a possible reason why BLAST products are now being distributed by Archon Paintball, rather than NPS as they had been for several years.

As the details become available they'll be reported here. Represenatives for both BLAST and NPS have been contacted for comment.

UPDATE:

We recieved a request from Mr. Long today requesting a phone coversation and in due course we spoke with Mr. Long regarding the pending lawsuit. He alleges that NPS and the associated companies involved owe him invoices totalling "Around $400,000". He also alleges that he's been owed this amount for over a year and half.

Mr. Long said that he'd have his daughter scan and email the original complaint in the matter so as to provide more information. The Federal Court Reporting system doesn't currently have the original complaint available.

Represenatives from NPS have responded as well, asking what precisely case #: 3:07-cv-01547-CRB was and that if we could provide specific information as to who the case involved, they may be able to comment.
how about them apples~!?

I suppose all those who hate Smart Parts have someone new to hate now. I say, good for BLAST for holding their distributers accountable.

people who hate smart parts don't have any idea what they are talking about.
and i garuntee people won't make a new "hate the suers" boat... because frankly, people liked who was getting sued in smartparts suit... this time... no1 likes them.

Smart Parts had every right to sue. Whether or not they deserved to have royalties paid on patents is debatable, but legally they were entitled to it, because a court of law ruled that. If you don't like it, blame your law system.

KEE violated rights that were previously shown as belonging to Smart parts so there is absolutely no question to whether or not royalties should be paid, since it is based on precedence, some defiance against smart parts could be understandable in the suing of agd etc, but with KEE there should have been no question. also KEE/NPS are *******s, and *******s stink.

Bob long and Procaps BOTH have outstanding contract issues with NPS and I'm glad Bob sued before he got legally crippled like dxs has... i hope this commotion will give DXS some time to formulate its suit for outstanding contract fees and ****slap them with some 200k+ suit.

NPS just became procaps, blast, and smartpart's ***** and it's about time imo.

they've done nothing but push smaller companies around and push boundaries of companies they knew wouldn't sue.

if bob said he needed more onyx's to sell to stay in the business, i would buy one for 1.5x its msrp if it wouldn't set me back like it would now (since im just in a teenagers job)

NPS is probably one of the worst distributors I deal with. I try to avoid them at all costs.

I wonder what would happen if NPS died... I mean, they control patents for such a large number of things... Would they collect royalties, or would their subsidiary companies (Halo, Empire, etc.) disappear aswell? That'd certainly throw the industry off balance.

Usually, if a company goes into bancruptcy (the normal form of corporate "death"), depending on the type of bankruptcy, I think a managing company is appointed by either the court or the shareholders. They would then control the patents and receive royalties. Of course, there's lots of way for a company to die.

Without Empire, I would be sad. 85% of my gear is Empire.

I don't think Empire and Oddesy, and the other NPS subsidary companies would die... I am pretty sure they would just branch out to another distributer.
